These Terms and Booking Conditions apply to surf lessons, surf guiding, equipment rental and related services booked with Sunset Waves Surf / SW Surf. Sunset Waves Surf is operated under the responsibility of Mohamed Bahnini from Imi Ouaddar 80500, Morocco.
By submitting a booking, the lead customer confirms that they are authorised to provide booking information for all participants and that all participants have been informed of the relevant conditions. A booking is not final until SW Surf confirms it in writing by website message, email or WhatsApp.
Customers must provide complete and accurate information, including full name, WhatsApp number, service date, number of participants or rental sets, participant ages when relevant, swimming and surfing experience, transportation needs and pickup location when applicable.
SW Surf may refuse, change or cancel a booking when information is missing or inaccurate, the requested service is unsuitable for the customer’s stated ability, equipment or staff are unavailable, payment is not completed, or safety or legal requirements cannot be met.
Website availability is provisional until SW Surf reviews the request. Lessons and guiding depend on ocean conditions, participant ability, instructor or guide availability and transport arrangements. Rentals depend on equipment and size availability.
The exact beach and start time for lessons and guiding may change from day to day. Customers receive a morning or afternoon arrangement, with the final time and location confirmed after conditions are checked.
Prices are displayed in US dollars. The complete amount and any optional charge must be shown or confirmed before payment. SW Surf will not add an undisclosed mandatory charge after confirmation.
Payment may be made in cash or by card through the website when available. SW Surf may require full payment before confirming or providing a service. Card payments are handled through the secure payment method available at checkout. SW Surf does not intentionally store complete payment-card numbers.
One rental set means one surfboard and one wetsuit.
Lessons last two hours and normally include approximately 90 minutes in the water. The remainder is used for the warm-up, safety information, board use and beach instruction.
Lessons are available for all experience levels. The minimum age is 10. A participant who cannot swim must tell SW Surf before confirmation so the lesson can be planned appropriately. A parent or legal guardian must book for a minor and remains responsible for providing accurate information and any legally required consent.
A surfboard and wetsuit are included. Transportation is included with private lessons and group bookings of five or more people. Transportation for groups of fewer than five may carry an additional price confirmed before booking.
Surf guiding is available only to customers who can swim and paddle out. Intermediate and advanced surfers may join. An experienced beginner may be accepted after discussing their ability, but complete beginners and non-swimmers must choose a surf lesson.
The standard guided portion lasts approximately 90 minutes. The customer may then surf independently for up to one additional hour. Mohamed is not in the water during that optional independent period.
Customers may request a surf spot, but no particular break, wave quality, crowd level or weather condition is guaranteed. The guide chooses or approves locations based on ability, access, waves, weather and ocean safety.
Rental-specific identification, collection, delivery, exchange, return, late, damage and loss conditions are contained in the Surfboard and Wetsuit Rental Terms. Those terms form part of the contract for every rental.
Transportation for lessons and guiding may be arranged between Agadir and Imsouane under the inclusion rules shown on the relevant service page.
Free equipment delivery is available for rentals of four days or more to an agreed location between Agadir and Imsouane. Shorter rentals are collected from and returned to the SW Surf shop in Imi Ouaddar.
Customers must provide an accurate pickup or delivery location and be present at the agreed time. Delays caused by an incorrect or incomplete location may shorten the available service time and do not automatically create a refund right.
Each participant must:
SW Surf may stop or refuse participation when continuing would present an unreasonable safety risk. No refund is due when participation is refused because of intoxication, abusive conduct, deliberate rule-breaking or materially false ability information, subject to mandatory law.
Surfing takes place in a changing natural environment. SW Surf may change the beach, route, meeting point, start time or date when conditions are unsuitable. Mohamed checks practical alternative spots before moving a guiding booking to another time or day.
If SW Surf cannot provide the confirmed service and no reasonable alternative is accepted, the customer will receive a refund for the undelivered service as required by applicable law.
The Cancellation and Refund Policy forms part of these terms.
Customers may cancel at least 24 hours before the agreed start, collection or delivery time for a refund. Customer cancellations made less than 24 hours before that time are not normally refundable. A late arrival may be moved to another available time or day, but does not create an automatic refund right. A no-show is not refundable, subject to mandatory law.
Optional lesson or guiding photos and video cost $10 per person, with any group reduction agreed before booking. Purchasing this service gives the customer the delivered personal-use media; it does not automatically authorise SW Surf to publish the customer’s image.
SW Surf may use identifiable customer media for its website, advertising or social media only with separate, optional permission or another valid legal basis. Refusing promotional permission does not affect the service.
Surfing and ocean activities involve risks, including changing waves and currents, collisions, falls, contact with boards or seabed, marine life, weather exposure and physical injury. SW Surf reduces risk through suitable planning, information, equipment selection and supervision appropriate to the booked service, but cannot eliminate all natural risks.
Customers remain responsible for following instructions and for independent surfing outside the guided or lesson period. Nothing in these terms excludes responsibility that cannot legally be excluded, including responsibility arising from SW Surf’s fraud, wilful misconduct or negligence where exclusion is prohibited by law.
Customers are responsible for phones, money, jewellery, documents and other personal property. SW Surf is not responsible for ordinary loss or water damage to personal items unless caused by responsibility that cannot legally be excluded.
Neither party is responsible for delay or failure caused by an event beyond reasonable control, such as severe weather, unsafe ocean conditions, road closure, official restriction, natural disaster, civil disturbance, epidemic or failure of essential infrastructure. SW Surf will offer a reasonable change, credit or refund where required by law and according to the part of the service that remains undelivered.
Send a complaint to [email protected] or WhatsApp +212 653 783 218 with the booking reference and relevant evidence. SW Surf will acknowledge and review the complaint promptly and try to reach an amicable resolution.
SW Surf processes booking and customer information as described in the Privacy Policy. Optional marketing and promotional-media consent is separate from acceptance of these terms.
The terms accepted at the time of booking apply to that booking. Later website changes do not retrospectively remove confirmed customer rights. SW Surf may update the terms for future bookings and will display the revision date.
These terms are governed by Moroccan law. They must be read consistently with Law No. 31-08 on consumer protection and other applicable rules. Nothing in these terms removes a mandatory consumer right, statutory withdrawal right where it applies, or access to a competent consumer body or court.
