These terms apply to every surfboard and wetsuit rented from Sunset Waves Surf / SW Surf. They supplement the Terms and Booking Conditions and Cancellation and Refund Policy.
One rental set contains one surfboard and one wetsuit. The board includes installed fins and a leash. It is supplied with the wax already in use. Fresh wax is sold separately. Roof straps are not provided.
The total rental price is paid before the equipment is released.
There is no minimum surfing level or minimum age for renting. Rental does not include instruction or supervision. The renter must choose conditions appropriate to their own ability.
A parent or responsible adult must complete the booking and rental agreement for anyone under 18 and is responsible for the minor’s compliance with these terms.
The responsible renter must present a valid driving licence. SW Surf takes a photograph of it for the rental record; SW Surf does not keep the original document.
The licence image is used for identification, contract administration, equipment recovery and the resolution of late, damage or loss issues. Its handling and retention are explained in the Privacy Policy.
Collection and return are available at the SW Surf shop in Imi Ouaddar every day between 9:00 AM and 6:30 PM.
A full-day rental may last up to 24 hours. The exact due date and time are written on the rental record and must fall within shop hours.
Free delivery to an agreed location between Agadir and Imsouane is available for rentals of four days or more. Rentals shorter than four days are collected from and returned to the shop. The customer must be present at the agreed delivery time and location.
The customer and SW Surf must inspect the surfboard, fins, leash and wetsuit at handover. Existing marks or damage should be recorded with the equipment description and, where practical, photographs.
The customer must promptly report a hidden problem discovered after handover and must stop using equipment that appears unsafe. The customer must not attempt a repair without SW Surf’s approval.
The customer may ask to exchange a board or wetsuit during the rental. An exchange depends on the models and sizes available and may require returning to the shop. No particular board model is guaranteed.
The customer must:
Equipment returned after the agreed due date or time is charged for every additional rental day at the applicable rate. The customer must contact SW Surf immediately if timely return becomes impossible. Continued possession without agreement may be treated as failure to return the equipment and may lead to recovery action.
If equipment is returned with damage beyond ordinary wear and can be repaired, the customer pays the reasonable actual repair cost. SW Surf will explain the damage and provide evidence of the repair amount where reasonably available.
The customer is not charged for damage recorded before handover or for a defect caused by ordinary wear, unless the customer made that defect worse through continued unreasonable use.
If a surfboard is broken completely through the middle during the rental, the customer pays 50% of the board’s documented replacement price. The replacement value should be shown on or attached to the rental record before handover wherever practical.
If equipment is lost, stolen or not returned, the customer pays its documented full replacement price, less any amount that applicable law requires SW Surf to credit. Reporting theft to the police does not automatically remove the customer’s contractual responsibility, although SW Surf will consider the circumstances and any recovered equipment.
Equipment rental does not include an assessment of ocean safety, a lesson or a guide. The customer is responsible for deciding whether they can safely use the equipment in the selected conditions. Customers who need instruction should book Surf Lessons. Surfers who want local spot assistance and can swim and paddle out should consider Surf Guiding.
Cancel at least 24 hours before the agreed collection or delivery time for a refund. Cancellations made less than 24 hours before that time are not normally refundable. Same-day rental is available subject to stock and becomes non-refundable once confirmed within the 24-hour period, subject to mandatory law.
The rental ends only when SW Surf receives and checks the complete equipment set. The customer should request confirmation that the equipment has been returned and note any amount still being assessed.
Nothing in these terms removes a mandatory consumer right or makes the customer responsible for pre-existing damage, ordinary wear or loss caused by SW Surf’s responsibility where liability cannot legally be excluded.
